How to Find Hidden Assets in Divorce
Some spouses attempt to hide assets before or during a divorce.
The first step in dividing assets during a divorce is to create a complete financial picture of all assets. These assets are generally categorized as follows:
- “marital” – property acquired during the marriage
- “separate” – property acquired before the marriage, through inheritance or gift, or after separation
- “comingled” – property that has been mixed during the marriage, like a bank or retirement account
If your spouse handled all the bookkeeping during your marriage and you were not involved in the finances, you don’t have immediate access to or knowledge of financial information. If this is you, your first course of action should be to ask your spouse for copies of all financial records. Your second course of action should be to consult with a family law attorney. If your spouse produces the records, the information gathering process might not be too painful, but if there is any resistance, your attorney will have to get involved.
If you believe your spouse is hiding assets, your attorney will need to use a formal legal process to get information and documents.
